In the proceedings at issue in which the parties must be represented by a lawyer it could not have been surprising to the parties that the contract at issue will be brought under the CISG, particularly as the prerequisites for its application pursuant to Art. 1 of the treaty which was in force in Austria at the time of the conclusion of the contract were clearly fulfilled.

Es konnte für die Parteien im vorliegenden Anwaltsprozeß nicht überraschend sein, daß der vorliegende Vertrag dem UNK unterstellt wird, sind doch dessen Anwendungsvoraussetzungen nach Art 1 des beim Vertragsabschluß in Österreich und Deutschland geltenden Übereinkommens klar erfüllt.
